Preamble:
Xynthetic Netlabel is indebted to the artists who participate in our releases and choose to make their tracks available through our website. We would like to say thank you to all the artists who have expressed their interest and support in what we are doing.
Thank you - Josh and Graeme
Xynthetic Netlabel Artist Agreement
(this does not apply to XDR series releases)
Artists (individuals or project entities composed of multiple individuals) retain ownership and all rights to the tracks and groups of tracks (releases) that they make available for download through Xynthetic Netlabel XSN series. Xynthetic Netlabel does not request or expect exclusive rights to the Artist's material released on the XSN series.
In cases of licensing requests that come to Xynthetic Netlabel, Xynthetic Netlabel will direct potential licensees to contact the Artist directly, unless other arrangements are explicitly made between Xynthetic Netlabel and the Artist.
Xynthetic Netlabel reserves the following rights to tracks and releases, unless other arrangements are explicitly made between the Artist and Xynthetic Netlabel:
1. Xynthetic Netlabel reserves the right to make the released track available online for download in perpetuity (or for the lifetime of Xynthetic Netlabel), under Creative Commons Attribution-NonCommercial-NoDerivs 2.5 licensing.
2. Xynthetic Netlabel reserves the right to use the track as-is or in edited form to promote the Artist and Xynthetic Netlabel in promotional material, which may include mechanical reproduction (most commonly recordable media).
3. Xynthetic Netlabel reserves the right to compile released tracks in the form of mechanical releases to be sold through the Xynthetic Netlabel store and other traditional distribution channels. In the event that a track or EP is selected for mechanical release, terms will be negotiated with the Artist (with an even split of profits between Xynthetic Netlabel and the Artist(s) being the basic agreement). Xynthetic Netlabel will retain ownership of the masters for mechanical reproduction of these releases.
3a. Xynthetic Netlabel does not offer advances, we don't pay for studio time, etc... Xynthetic Netlabel pays to get the product manufactured. Profits are considered to be income received from the sale of a release over the cost of the manufacturing of the release (including mastering paid for by Xynthetic Netlabel to be recouped once across the sales lifetime of the release). Advertizing for mechanical releases will be dealt with on an ad hoc basis, and we will cross that bridge if and when we get there.
4. Graphics created by Xynthetic Netlabel related to releases are the property of Xynthetic Netlabel. Source graphics (photos, logos, etc...) provided by the Artist related to releases remain the property of the Artist, though the final graphics derived from the source material will be considered property of Xynthetic Netlabel.
By releasing with Xynthetic Netlabel, the Artist implies agreement with the following:
1. Tracks released through Xynthetic Netlabel are DRM-free and made available through Creative Commons Attribution-NonCommercial-NoDerivs 2.5 licensing. In some cases releases may be posted with Attribution-NonCommercial-ShareAlike 2.5, these releases will be explicitly agreed upon by the Artist and Xynthetic Netlabel, and are likely to involve remix contests and the like.
2. Tracks released through Xynthetic Netlabel are available for use in non-commercial podcasting; may be played on the radio or as part of online radio streams; may be performed publicly by DJs; may be played on a public address, hi-fi, or other stereo system located within a business; may be recorded to media or stored to media as either audio or data by people who download it; may be freely distributed by people who download it as long as the distribution is for non-commercial purposes, and proper attribution is maintained.
3. Tracks may not appear in commercial releases or be licensed for commerical purposes without explicit permission from the Artist. This includes things such as: being used in a soundtrack for advertizing or entertainment media of any form, being included in a compilation to be sold, etc...
4. The Artist will notify Xynthetic Netlabel if they will be releasing material released through Xynthetic Netlabel with another label. This is for the benefit of Xynthetic Netlabel, so that we know material that was released through Xynthetic Netlabel will be coming out elsewhere and it prevents us from sending incorrect cease-and-decist and/or Artist compensation requests. It also gives us an opportunity to cross promote the other release on our website.
5. The Artist deserves to get paid for tracks used for commercial purposes.
